1. BudgetBikes Bicycle Tour and Rental Service
BudgetBikes S.L. (hereafter referred to as “BudgetBikes”, “we” or “us”) is a bicycle rental and tour company offering its services to its clients, the person(s) signing the rental or touring contract (hereafter referred to as “you”). BudgetBikes operates in Barcelona under Spanish law, with its business address at C/Estruc 38, 08002, Barcelona, Spain and with Chamber of Commerce number B64033848.
2. Bike Rental and Tour Price
The bike rental price is determined by the rates mentioned on the BudgetBikes website (www.budgetbikes.eu) at the time of the booking, or as subsequently detailed on a quote or on your booking confirmation. Prices are valid for a period of 28 days after the date mentioned on the quote or on your booking confirmation.
3. Online Booking
You can book a tour by calling our booking number +34 933041885, by coming to one of our shops in person or through our online booking form, available at www.budgetbikes.eu. Your online booking will be considered confirmed when you receive a booking confirmation per e-mail from BudgetBikes. However, if you book less than 48 hours prior to the departure of your requested tour, we recommend that you confirm your booking by calling +34 933 041 885. a. The bicycle rental and tour price and any other due sums regarding the rental agreement must be paid before the bicycle(s) is/are handed over to you. If you decide to rent your bicycle(s) for a longer period than you paid for, just let us know by the end of the rental period. The same prices will apply as mentioned on the website and payment will be settled when returning the rented bicycle(s).
b. If, for whatever reason, you cannot make use of the bicycle(s) you have rented or the tour you have booked, BudgetBikes will not be held responsible for any resulting expenses or damage.
c. In the case of 2b, you remain obliged to pay the full rental price or tour price and any other amounts mentioned in the invoice, unless you can prove that your not being able to use the bike or to go on the tour was the consequence of a defect that was already present at the beginning of the rental or touring period.
Before receiving the rental bicycle(s), you must leave a deposit of €100, to be paid in cash or with credit card. The deposit will be returned to you upon returning the bicycle(s) in good order.
a. The rental period or touring period are the periods as stated on the booking confirmation.
b. Extension of the rental period is possible only after approval by us and according to the rental rates as mentioned above (1).
c. No refunds are possible after the rental period or touring period begins. If you return the bicycle(s) to us before the end of mentioned period, the rental or touring agreement will automatically be terminated, without altering the payment done at the start of the rental or touring period.
d. At the end of your rental or touring period, the bicycle(s) must be returned to the BudgetBikes shop from where it was/they were issued.
e. If the bicycle(s) is/are not returned by the return time stated on the booking confirmation, we will continue to charge you rent until the bike(s) is/are returned to us or is/are received by us. In the event of late return, the rates as mentioned above (1) will continue to apply. We also reserve the right to demand payment for any costs and/or damages suffered by us due to late return of our rental bicycle(s).
f. Notwithstanding the preceding paragraph, in the event of late return of our rental bikes, we reserve the right to dissolve the rental agreement without judicial intervention and immediately claim back our bicycle(s) wherever it/they may be and from whomever has it/them. BudgetBikes also holds this right in the event that you do not comply with any of the other conditions stated in this rental agreement.
7. Cancellation Policy
In case of the cancellation of a tour or rental booking, you will receive a refund of 80% of the rental or touring fee if the cancellation takes place up to a week before the beginning of the rental or touring period. If cancellation takes place a week to 24 hours before the start of the rental or touring period, you receive a refund of 50% of the rental or touring fee. There is no cancellation possible in case of rain or other weather related reasons. If necessary, BudgetBikes will offer an alternative rental- or touring period, or activity.
8. Proper Use
a. The bicycle(s) may only be used for its/their intended purpose. The client listed on the contract is responsible for the proper use of all bicycles listed on the contract and all persons using the bike.
b. The bicycle(s) must be returned to us in the same clean state in which you received it/them.
c. You must take excellent care of the bicycle(s), as if it/they were your own. You must take every precaution against damage, loss or theft.
d. The bicycle(s) may not be used on the beach, on sandy paths or other surfaces unfit for cycling: in these circumstances, you will walk beside the bicycle until reaching a properly paved or prepared surface.

9. Damage, Loss and Theft
You assume full responsibility for any damage to or loss of the bicycle(s) or parts of it/them, as well as bicycle keys, chains and locks, and for any possible damage related to the use of the rented bicycle(s). You also agree to compensate BudgetBikes the cost of repair or replacement of the bicycle(s) for such an amount as is determined by us according to standard market prices. To replace a stolen bicycle, €420 will be charged (including locks) per bicycle. You can purchase a Bicycle Theft Insurance at the beginning of your rental period, insuring you in case of theft of the whole bicycle, not of bicycle parts. In any case, you are the sole responsible for possible damages to yourself, the bicycle and third parties. BudgetBikes does not assume any responsibility for any personal injury or other damage caused by the use of the rented bicycle(s).
10. Theft Insurance
It is possible to purchase a Bicycle Theft Insurance at the start of your rental (or touring) period. Covered are: damages arising out of the theft of the bicycle; and damages to the bicycle as a consequence of the theft, in case the bicycle is recovered. Not covered are: theft of bicycle parts; and damages arising out of attempted theft. The insurance premium is as stated above (1). The number of insurance days is equivalent to the rental or touring period as stated on your booking confirmation.
11. Liability in the Event of Theft
a. If you did not purchase a Bicycle Theft Insurance from us before the start of the rental or tour period, you will be held fully accountable for the sum determined above (9).
b. If you did purchase a Bicycle Theft Insurance from us, and your bicycle(s) is (are) stolen, the Bicycle Theft Insurance is only applicable if you hand over all bicycle keys and an official theft report drawn up by the police. If you cannot meet these conditions, you will still be held fully accountable for the sum determined above (9).
12. Costs During the Rental Period
Any charges and taxes regarding the rental bicycle(s), such as for example fines and ferry tickets, are to be paid by you. You will also be required to pay all costs ensuing from the use of the bicycle(s) such as parking fees, maintenance and repairs.

14. Force majeur
If BudgetBikes cannot fulfil its obligations to you as a result of circumstances beyond its control, the obligations will be suspended for the duration of the force majeure. In this context, force majeure will mean any circumstance independent on BudgetBikes’ will, which partly or wholly prevents the fulfilment of its obligations towards you or which reasonably renders the requirement to fulfil such obligations impossible, regardless if such circumstance could have been anticipated. Force majeure includes in any case: emergency situations (including extreme weather conditions, fire and lightning strike), restrictions and/or amended rules and regulations by governments or government agencies, (work) strike, war, riot, power failure, unanticipated failure of computer hardware and other facilities.
15. Applicable law
All agreements between BudgetBikes and its clients are exclusively governed by Spanish law.
